Is a Decat a defo MOT fail?

So, when I put the Decat back on, the stupid nut sheared off and the exhaust is also lodged into it. So I wanted to know whether or not it is a defo fail or is there a possibility that it might pass? Anyone had any experiences as the answers online are varied?
 
mot rules if applied to the letter of the law is if a cat is "missing" its a fail
 
It will depends on how strict the tester is really. As Foxspeed says, it is technically an instant fail if a cat that was there from the factory has been removed.

However, a tester might not notice as they'll still see the first cat in place at a glace. They might also not be bothered as like Chris says, it should still pass emissions test with just the precat.

Mine passed an MOT no worries with a de-cat pipe fitted.
 
Just to add , the placement of the cat just before the centre section is the normal position for most cars so it may cause them to question it not being present. Depends on the tester though as already said.
